When does time-and-a-half kick in?

Under the federal Fair Labor Standards Act (FLSA), non-exempt employees earn time-and-a-half for any hours worked over 40 in a single workweek. Your workweek is a fixed 168-hour period set by your employer — it doesn't have to start Monday.

State rules that override federal

  • California: 1.5× for >8 hours/day OR >40/week. 2× for >12 hours/day OR >8 hours on the 7th consecutive workday.
  • Colorado, Nevada: 1.5× for >12 hours/day (Colorado) or >40/week.
  • Alaska: 1.5× for >8 hours/day OR >40/week.
  • Most other states: Follow federal FLSA (over 40/week only).

Who is exempt from overtime?

Do I get overtime if I'm paid salary?

Depends. Salaried employees who earn above the FLSA threshold AND perform exempt duties (executive, administrative, professional, computer, or outside sales) are not entitled to overtime. Everyone else — including most "salaried" retail, entry office, and technical roles below the threshold — IS owed overtime.

How do I calculate overtime on a bonus?

Non-discretionary bonuses (attendance, production, safety) must be added into your "regular rate" before calculating OT. Formula: (weekly earnings + prorated bonus) / hours worked = adjusted hourly. Multiply by 0.5 × OT hours for the additional OT due.

Can my employer offer comp time instead of overtime pay?

Private-sector employers generally cannot give comp time in lieu of overtime wages under federal law. Public-sector (government) employees sometimes can. If your private employer is doing this, they may be violating FLSA.

What if I worked unauthorized overtime?

You must still be paid for it. Your employer can discipline you for working unauthorized hours but cannot refuse payment. This is a common FLSA violation.
